Terms of use

These terms govern the use of the Mühür Mail service (the "Service") provided by Ahmet Aksungur (Aksungur Yazılım) (the "Service Provider"). Anyone who signs up for or uses the Service is deemed to have accepted these terms.

• User: a natural person who opens a Mühür Mail account.
• Organization: the workspace of a company or sole proprietorship in Mühür Mail; the team, domains, mailboxes and subscription belong to the organization.
• Team member: the owner of an organization or a user an authorized team member invites with a role.
• Mailbox user: a person for whom the organization opens a mailbox on its own domain.

Mühür Mail is a subscription-based email service that aims to host organizations' email addresses on their own domains, with webmail, a mobile app and standard IMAP/SMTP access. Mühür Mail does not register domains and does not hand out addresses on its own domain; mailboxes are opened only on domains whose ownership has been proven. The Service is in preparation; modules open gradually, and the modules available for use are shown in the dashboard. The scope and limits of plans are stated in the dashboard and in the quote.

• You provide accurate and up-to-date information when you open an account; you may be asked to verify your email address and phone.
• You don't share your password with anyone and you're responsible for actions taken in your account. If you notice unauthorized use, tell us immediately.
• The organization owner and admins invite team members with roles (admin, billing manager, helpdesk, member); team members can only do what their role allows. The organization is responsible for its team's actions.
• Ownership of an organization can be given to another team member by the current owner.

• Domains connected to Mühür Mail must belong to the organization, or the organization must be authorized to use them. Ownership is verified with a DNS record added to the domain; a domain that isn't verified isn't activated.
• The organization is responsible for the accuracy and lawfulness of the organization, billing and mailbox details entered in the dashboard.
• The organization is the data controller for the personal data of its mailbox users and the people it corresponds with, and is responsible for informing them and, where necessary, obtaining their explicit consent. Mühür Mail is the data processor for this data (see the KVKK privacy notice).
• Obtaining the consents needed for messages and SMS sent on behalf of the organization, and complying with commercial message legislation, are the organization's responsibility.

• Mühür Mail is designed for person-to-person and transactional business correspondence; bulk marketing sends (newsletters, campaigns) are not part of the Service.
• A user can send messages only as their own address, their own aliases and the shared mailboxes they have been given access to.
• Sending is subject to rate limits, daily quotas and outbound scanning. Suspicious sending (for example signs of a compromised account) may be stopped automatically; the user and the organization's admin are notified.
• Recipient addresses that fail permanently are added to a suppression list and are not retried.
• Whether a message reaches the recipient's inbox also depends on the recipient server's decisions; the Service Provider does not promise any particular delivery rate.

• The assistant's replies are generated by AI and may contain errors; they are not a substitute for legal, financial or technical advice.
• The assistant only looks at records within the user's permissions; message content is never sent to the assistant without the organization's explicit permission. Actions that send or save something are taken only with the user's approval and are logged.
• The monthly message quota depends on the plan; when the quota is used up, the assistant can't be used until the next month unless the plan is upgraded.

• Plans are offered monthly or yearly; plans without a listed price are sold by quote. Prices are published excluding VAT.
• New organizations start with a free 30-day trial; no card is needed for the trial. During the trial, the Professional plan's limits apply.
• When the trial or subscription ends, the management dashboard becomes read-only; records aren't deleted.
• Unless canceled, the subscription renews with the same plan at the end of each period and the period fee is charged to the saved card.
• Cancellation takes effect at the end of the paid period. No refund is given for a used or started period.
• When you change plans, the new plan starts a new period as soon as the payment is approved; no cash refund is given for the unused days of the previous plan.
• Price changes are emailed to the organization owner before they take effect and don't affect a period that's already paid.

Details of the purchase are in the pre-contract information form, the distance sales agreement and the cancellation and refund policy.

Each plan has a team member limit and a monthly assistant message limit; mailbox, storage and sending limits are added to plan scope along with the mail service. When a limit is reached, existing records aren't affected; only new additions are blocked. SMS are sent from the organization's own SMS provider account and paid to that provider. Automated use that puts unusual load on the Service's infrastructure may be limited.

Records the organization enters in Mühür Mail, or that are created in Mühür Mail on the organization's behalf (including messages and attachments), belong to the organization. The Service Provider processes these records only to provide the Service, keep it secure and meet its legal obligations; it doesn't sell them or use them for advertising. The platform team does not read message content.

• Using the Service for unlawful purposes or to process other people's personal data without a legal basis.
• Sending unsolicited bulk messages (spam), phishing or malware; impersonating another person or organization.
• Trying to connect a domain you don't own or aren't authorized to use.
• Trying to gain unauthorized access to another organization's or user's records, or trying to bypass security measures.
• Reverse engineering, copying or reselling the Service without permission.

We take reasonable care to keep the Service running without interruption and announce planned maintenance in advance where possible. Interruptions caused by third-party services (domain and DNS providers, recipients' email servers, SMS providers) are outside the Service Provider's control. In case of a serious breach of these terms, failure to meet payment obligations, spam or misuse, or use that endangers the Service's security, the Service Provider may suspend the account, a mailbox or the organization, giving notice in advance where possible. The organization can cancel its subscription at any time.

To the extent permitted by law, the Service Provider isn't liable for errors in the records the organization enters, for decisions the organization makes, or for the operation of third-party services (domain and DNS providers, recipients' email servers). The statutory rights of users who are consumers are reserved.

• Significant changes to these terms are announced by email or in-app notification before they take effect.
• These terms are governed by Turkish law. The courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction over disputes; the jurisdiction of consumer arbitration committees and consumer courts is reserved for users who are consumers.
• If any provision is held invalid, the other provisions are not affected.
